When quality is measured by inspection,the quality is determined by the on-site inspection staff of the importer or the importer’s agents.It applies to non-standardized products,such as ornaments,craftwork,agriculture commodities and heavy machinery or,for occasions,of a transaction on the spot,a consignment,a trade fair,an auction or an exhibition.
♦Measuring quality by sample凭样品衡量质量
You may also measure quality by sample,which is a small quantity of products randomly taken out from a whole lot,or specifically designed and processed for a customer for reference or for confirmation before mass production.Depending on the party who provides the sample,a sample could be a seller’s sample,a buyer’s sample,or a return sample,which is the seller’s copy of the buyer’s sample for the buyer’s confirmation.To prevent possible disputes about quality,the following tips need to be noted before you send samples to the importer:First,the sample should be of average quality,representing the whole lot.You don’t want yoursample to be too super or too poor in quality.Second,keep a copy of the sample with yourself and with an agreed-upon notary or inspection institution; alternatively,both you and the importer may keep some copies of the confirmed samples and seal them as sealed samples.Third,don’t use sample together with another measurement of quality,such as specifications,which tends to cause disputes resulting from a double standard.If the importer does need a sample in addition to a quality term in the contract,you’d better state explicitly in the contract that “the sample provided is just for reference”.
