［Abstract］The children with disabilities are the most vulnerable ones among the vulnerable groups.The actions of protecting the education right for the disabled children have direct and important function to the growing and development of them.Nowadays，the laws and legislations on the education rights of disabled children have many problems，including irregular illustration，narrow scopes for the inclusion of the disabled children issues into the national voluntary education system and too principle of the legislations.We should have the correct understandings for the law ideology and formulated the special education law.The current laws and legislation related to this field should also be revised in order to protect the workable of the laws on the children with disabilities.The disabled children can enjoy the education right.
