14.2.7　Claim索赔

If a delayed delivery causes you a loss or the goods are found defective upon arrival,you may make a claim against the party or parties that you believe to be responsible.Here are some tips for doing that:

♦Find out the cause and determine the responsible party for the damage or loss.The responsible party could be the exporter,the carrier,or the insurance company,etc.,depending on the nature and cause of the damage or loss.

♦Claim against the responsible party with sound evidence,such as records of accident,necessary certificates and reports,physical evidence and photos,etc.

♦Watch for the allowed period for claims.The claim against the responsible party should be submitted within the prescribed period and would be invalid after expiration.The valid period for claims is usually stipulated in the contract.

♦The amount of claim should be determined taking consideration of the specific circumstances,which normally include the value of the damaged goods and related expenses such as the inspection fees.
