Apparently,if you trace damages to an act causing it,it would look inevitable that the act must have been negligent.But the question of determining negligence,as Lord Judge Scrutton puts it,depends on “whether a reasonable person would foresee that the act would cause damage;if he would not the act is not negligent.” That question,a question of fact,should be decided by a jury,rather than by the court.(https://www.daowen.com)
