IX.Video-on-Demand

Radio and television video-on-demand services refer to the business activity of providing users with the radio and TV programs available for users to select by themselves through the radio and TV technical system in the forms of real-time video-on-demand, near video-on-demand (carousel), playing after downloading and other video-on-demand forms.State Administration of Radio and Television shall be responsible for the administration of video-on-demand services throughout the country,develop the overall planning for video-on-demand services throughout the country, and determine the total quantity and distribution of institutions launching video-on-demand services.The local administrative departments of radio and television at or above the county level shall be responsible for the administration of video-on-demand services within their respective jurisdictions.

1.License.The state shall implement the licensing system for video-on-demand services.Without permission, this business cannot be engaged.An institution intending to launch video-on-demand services shall obtain a Permit for Radio and TV Video-on-Demand Services,which includes items such as the subject, scope, program category, and transmission mode.The Permit for Radio and TV Video-on-Demand Services shall be classif ied into Category A and Category B, and is valid for 3 years, calculated from the date of issue.If, upon the expiration of the valid period, the holder of the Permit needs to continue to operate video-on-demand services, it shall, six months prior to the expiration,undergo the renewal formalities under the approval procedures as prescribed by the law and regulations.The institutions launching video-on-demand services shall start broadcasting within 90 days after receiving the Permit for Radio and TV Video-on-Demand Services.If the broadcast cannot be started on schedule due to special reasons, the consent of the license-issuing authority shall be obtained or it shall be deemed to have terminated the business.

(1) Permit for Radio and TV Video-on-Demand Services (Category A).An institution that holds this permit may engage in video-on-demand services within the administrative region as specif ied in the permit.The broadcast front-end of the institutions launching video-on-demand services shall achieve the networking with the monitoring system of video-on-demand services of the State Administration of Radio and Television.The institutions that are qualified to apply for this permit are: ①the radio stations and TV stations at or above the prefecture (city)level established upon approval; ②the radio, film and TV groups (headquarters) established upon approval.(https://www.daowen.com)

(2) Permit for Radio and TV Video-on-Demand Services (Category B).An institution that holds this permit may engage in video-on-demand services in the hotels as specif ied in the permit.The broadcast front-end of the institutions launching video-on-demand services shall achieve the networking with the monitoring system of video-on-demand services of the provincial radio and television administrative department.The institutions may apply for this permit are: ①three-star or above hotels, or those equivalent to three-star or above hotels; ②the institutions that are able to provide ten or more three-star or above hotels or those equivalent to three-star or above hotels with video-on-demand services.

2.Requirements of video-on-demand content.Programs produced for video-on-demand services shall comply with the provisions of the Copyright Law.The programs produced for video-on-demand should be mainly domestic programs and are limited to the following five categories: (1) The films and TV series that have obtained a TV Series Distribution License and a Permit for Public Projection of Films.(2) The programs produced or broadcasted by the radio&TV broadcasting institutions legally formed.(3) The programs produced by the radio&TV production and operating institutions legally formed.(4) The foreign radio and TV programs examined and approved by the radio and TV administrative department at or above the provincial level.(5) Weather forecast, stock market quotation and other information programs obtained by legal means.
