I.Regulatory Authority and Compliance System of Commercial Stage Performances

The culture administrative department of the State Council shall be responsible for the supervision and management of national commercial stage performance.The public security department and the administrative department of market regulation of the State Council are responsible for the supervision and management of commercial stage performances within their respective duties.According to the State Council Institutional Reform Plan (2018), the duties of the Ministry of Culture and the China National Tourism Administration were integrated to establish the Ministry of Culture and Tourism as a component of the State Council.The Ministry of Culture and the National Tourism Administration are no longer retained.Now the unit in charge of commercial stage performances is the Ministry of Culture and Tourism, and the local cultural and tourism bureaus at or above the county level are responsible for the supervision and management of commercial stage performances in their administrative areas.

The laws governing commercial stage performances exist in all aspects, but they are scattered in the aforementioned various regulations and are not easy to understand and grasp.This chapter sorts out the compliance system for commercial stage performances so that readers can form a systematic understanding and have practical guidance.

The compliance system of commercial stage performances (as shown in the figure below) mainly includes three perspectives: (1) compliance of the performance host; (2) compliance of the performance itself; and (3)compliance of the performance venue, of which:

1.Performance host: (1) Establishment of : a.performance brokerage institution (for compliance requirements, see Section 2.1.1 of this chapter); b.the cultural and artistic stage performance groups (for compliance requirements, see Section 2.1.2 of this chapter); c.individual actors (for compliance requirements, see Section 2.1.3 of this chapter); d.Performance venue operating entities (but should be limited to holding performances in the venues they operate.For compliance requirements,see Section IV of this chapter); please note the individual performance brokers (cannot hold performances, can only engage in intermediary and agency activities for commercial performances, see Section 2.1.4 of this chapter for compliance requirements).(2) Operation (see Section 2.2 of this chapter for compliance requirements).(https://www.daowen.com)

2.The performance itself: (1) Examination and approval permission(for compliance requirements, see Section 3.1 of this chapter); (2) Performance content (for compliance requirements, see Section 3.2 of this chapter).

3.Performance venues: (1) Establishment (for compliance requirements, see Section 4.1 of this chapter); (2) Operation (for compliance requirements, see Section 4.2 of this chapter).
