VI.Import Services of Audio and Video Products
The import business of audio and video products includes importing the audio and video products used for publication or the finished audio and video products used for wholesale, retail or lease, etc.The business of importing finished audio and video products shall be operated by the entities engaging in the import of finished audio and video products which are approved by the competent press and publication department of the State Council.
To establish an importer of finished audio and video products, the applicant shall submit an application to the General Administration of Press and Publication, obtained a Permit for Importing Audio and Video Products from the General Administration of Press and Publication after approval, and collect a business license at the administrative department for market regulation on the basis of the Permit.
An importer of audio and video products shall meet the following conditions: (1) it has a name and articles of association; (2) its sponsor and the competent authority meet the requirements of the General Administration of Press and Publication; (3) it has a definite business scope;(4) it has the ability to preliminarily examine the contents of the imported audio and video products; (5) it has capital suitable for the business of importing audio and video products; (6) it has fixed business premises;and (7) other conditions as prescribed by laws, administrative regulations and provisions of the state.
Importing the audio and video products is subject to a licensing system, and one shall report the contents to the competent press and publication department under the State Council for examination.The press and publishing administrative department under the State Council shall make a decision within 30 days from the date of receiving the application for reviewing the contents of audio and video products, and issue approval documents if the application is approved.The import entity shall go to the Customs for going through import formalities with the approval document issued by the press and publishing administrative department of the State Council, and the audio and video products used for publishing shall also go through the registration in the copyright administrative department of the State Council.(https://www.daowen.com)
To import finished audio and video products, an importer of finished audio and video products shall apply to the press and publication department of the State Council and submit the following documents and materials: (1) an application form for examination of imported audio or video products; (2) a draft import agreement or an order form; (3) a sample program or lyrics in Chinese or a foreign language; and (4) other materials required for the content examination.
To import audio and video products used for publication, the importer shall apply to the press and publication department of the State Council and submit the following documents and materials: (1) an application form for examination of imported audio or video products; (2)the Chinese and foreign language versions of the draft copyright trade agreement, original copyright certificate, copyright authorization certificate, and registration documents issued by the National Copyright Administration; (3) a sample program; (4) tracks, lyrics or dialogue in Chinese or a foreign language; and (5) other materials required for the content examination.
The law also has some special requirements for the import of some special-purpose audio and video products.Whoever imports the audio and video products used for exhibition or display shall, after being approved by the competent press and publication department under the State Council, go through the formalities of temporary import at the Customs.While whoever intends to import audio and video products for reference in research or teaching shall not be used for profit-making reproduction, wholesale, retail, lease or projection.
