V.Compliance Points of Advertising Agents
According to Article 2.3 of the Advertising Law, the advertising agent in the Advertising Law means a natural person, a legal person, or any other organization that accepts authorization to provide advertisement design,production, and agency services.The advertising agents shall have legal business qualifications and abide by the entity body qualifications and review procedures stipulated by the advertising laws and regulations.
Advertising companies registered in China and companies that have obtained independent legal person qualifications and business licenses and engaged in design, production, distribution, and agency of various domestic and foreign advertising businesses can apply for corporate qualification levels.According to the Measures on Advertising Industry Qualification Recognition of China, the application process is as follows:apply for the qualification level to the advertising association where the registration is located (if there is no advertising association in the registration place, directly to the upper level of advertising association);companies registered in the State Administration for Market Regulation(provinces, autonomous regions, and municipalities that have not yet carried out the work of identifying corporate qualification) may apply directly to the China Advertising Association for corporate qualification levels.(https://www.daowen.com)
An Internet advertising agent shall assign advertisement examination personnel familiar with advertising regulations, and, if possible, shall establish a special institution to be responsible for the examination of Internet advertisements.
