【注释】
[1]It may be that his contribution in the field of private international law has been slightly over-estimated,since his forerunners had done more than merely prepare the way for him.
[2]As the distinction between real and personal was not always easy, and a category of mixed statutes was sometimes resorted to.However, contrary to what this term might connote,it did not really describe a new category of statues.Rather it encompassed all those personal laws which on closer examination, were thought to operate territorially.See LUTHER L.MCDOUGAL III & ROBERT L.FELIX,AMERICAN CONFLICTS LAW: CASES AND MATERIALS 5 (2004).
[3]B.Currie’s governmental interest analysis is just an example.
[4]However,neither the nebulous notion of comity nor the less vague but equally problematic terms of “acquired rights” provide concrete guidance as to the circumstances in which the forum will or will not apply the law of another state.FRIEDRICH K.JUENGER,CHOICE OF LAW AND MULTISTATE JUSTICE 21 (2000).
[5]Carl von Savigny served as Prussian Minister of Legislation and was part of the early 19th century Prussian attempts to reform German institutions in the light of the triumphs of the armies of Napoleon.Savigny’ s views were outlined in Vom Beruf unserer Zeit für Gesetzbung und Rechtwissenschaft (On the Vocation of our Age for Legislation and Jurisprudence); Das Recht des Besitzes (1803) (translated as The Law of Possession (1848)).
[6]Savigny’s views are set out in his System des Heutigen Romischen Rechts (1849) in the final volume. The eight volumes were translated into English as System of Modern Roman Law,by William Guthrie in 1869,although,prior to that date, they had been cited by counsel in the case of Liverpool,Brazil and River Plate Navigation Company v.Benham,The Halley (1868) LR 2 PC 193.
[7]The Chinese edition of System des Heutigen Romischen Rechts (1849) was published by Law Press (China) in 1999; however, frankly speaking, the translation quality is far from satisfactory.See FALV CHONGTU YU FALVGUIZE DE DIYU HE SHIJIAN FANWEI— XIANDAI LUOMAFA TIXI (Vol.8)( trans.by Li Shuangyuan el.)
