As a general principle,a court called upon to resolve a civil dispute with foreign elements must choose a law to apply to the problem.However,that choice often is not easy to make,and the task is further complicated by the need to select a method to use in choosing the appropriate law.It is not surprising,therefore,that the search for a system for choice of law has occupied a great deal of judicial and academic time and effort.
In this light,this part will focus on the conflict rules that scatter through various Chinese laws,including the Conflicts Act enacted in 2010,whose balance will be devoted to a survey of selected areas of Chinese conflict rules,analyzing the relevant legislation as well as judicial practice and,providing systematic comments.The highlighted areas are chosen partly for their importance in terms of their effect on the relationships between China and other states and between Chinese citizens and foreigners,and partly because of the lack of available materials other than these subjects.
