【注释】
[1]It is further asserted that the extraterritorial effects of foreign law are recognized under certain conditions, the most important of which is mutuality,i.e.,mutual recognition.See GUOJI SIFA [PRIVATE INTERNATIONAL LAW] 12-15 (Huang Jin ed.,2nd ed.,2004).
[2]Legal historians disagree over the actual date of the Tang Code, some suggesting it was only published in 652.
[3]The original Chinese text is:“诸化外人,同类自相犯者,各依本俗法;异类相犯者,以法律论.”
[4]The original Chinese text is:“凡化外人犯罪者,并依律拟断.”
[5]The original Chinese text is:“原虽非我族者,归附即是王民,……并依常法律拟段.”
[6]Japanese introduced Chinese characters to express Japanese in writing around the 1st and 4th century B.C.Even today,a large number of Chinese characters are still used in modern Japanese language. The Chinese characters of “Hōrei” are “法法.” The term “Hōrei” was used in ancient China in the Jin Dynasty (265-420) as the name of the general rules for its statutes; however,it had been forgotten in China and had never been used since the fall of the Dynasty.
[7]For instance,Professor HAN Depei puts forward “the Airplane Doctrine,” and some Chinese scholars advocate the doctrine of “uniform substantive law rules.” See GUOJI SIFA [PRIVATE INTERNATIONAL LAW] 383-398 (Huang Jin ed.,2nd ed.,2004).
