六、结束语
随着世界经济发展和全球范围内投资浪潮的兴起，RTAs的数量迅速递增。范围方面也不再只局限于贸易，包括投资、金融、环境、劳工、争端解决等各方面的内容也逐渐成为RTAs中的一部分。贸易和投资自由化和便利化的追求使得在RTAs中对投资规则作出规定，特别是专章规定的做法越来越普遍。
不可否认，在RTAs投资规则谈判和实施的过程中确实存在不少固有利益的冲突，特别是投资者财产权和东道国的人权保护这两方面。从RTAs投资规则目前签订的情况来看，各国都充分地考虑自身经济发展的水平和速度，在关系自身利益较小的议题上作出让步，以获取最大利益。发展中国家和发达国家的合作，更体现了不同经济发展水平的国家之间在投资与人权方面的平衡。尽管路途艰辛，但是反对在RTAs投资规则中纳入有关的人权规定的声音已经越来越远。劳工、环境、公共福利等人权事项和投资的共同发展已经成为现在各国的发展诉求。事实证明，投资与环境、公共利益保护等人权问题共同进步其实并不相矛盾。
总而言之，无论是发达国家还是发展中国家，在积极参与国际贸易和投资的同时都应当主动积极讨论其中所涉及的人权问题。最后，在国际投资和各国经济发展水平、利益追求方式、历史文化传统、法律价值取向当中寻求解决问题的最佳途径。

Study on the Relationship between RTAs and Human Rights of Investment Rules

Abstract:The relationship between the RTAs investment rules and human rights is one of today’s main topic,also it is main topic in this paper.The author at first discusses the relationship between RTAs investment rules and human rights;on this basis the United States and the European Union are seen as the typical cases of the relationship between the investment rules and practice of human rights and are analyzed in-depth.The authors argued that the EU has established a link-up between the international agreements involved investment agreements in RTAs and the EU’s"human rights clause".The United States is thought as the investment rules are hooked on the human right,for instance,NAFTA,AUSFTA and TPP,and in 2012 the Model Bilateral Investment.China is the fourth case:that China signed RTAs linked the investment rules with the human rights is not very much during the past years,but China might consider changing the current practice situation as negotiating with US on BIT agreements.Finally,the article analyzes the RTAs investment rules and development trends in the legal protection of human rights and politics from both international and domestic perspective.
