4.1.3.1 “More or less”clause数量溢短装条款

A complete “more or less”clause should generally include three elements:First,the allowed range of variance in quantity,which is often expressed as a percentage of the total quantity.Second,the party who determines the quantity to be delivered,which is mostly the exporter in practice,but the importer may also determine for convenience if he/she charters the ship so that the quantity to be delivered is limited by the capacity of the ship.Third,the price used to calculate the value of the over-load or under-load portion of the merchandise.It is generally calculated based on the contract price,though sometimes market price at the time of loading or unloading is also applied to prevent an intentional overloading or under-loading by the party who determines the “more or less”quantity.The following is an example of a “more or less”clause:“Quantity:100,000 M/T,5% more or less,at exporter’s option and at contract price.”
