8.5 Procedures for Filing a Claim提出索赔的程序
If a certain risk does occur,resulting in a damage or loss,most underwriters require immediate notice be given to their nearest branch or agency.When notified,the branch or agency appoints a surveyor to inspect the cargo and produce a report on the nature and extent of the damage or loss.The surveyor normally sends the report together with his/her findings to the consignee,with the latter paying the fee for inspection.When a claim is filed,the fee is refunded to the claimants if the loss is covered under the insurance policy.
Under some circumstances,the claim is returned to the place where the insurance is originally arranged and subsequently presented to the underwriter.However,when goods are sold under CIF terms,the insurance policy would be transferred and sent to the consignee and therefore any claim should be indemnified at destination.In such cases,the consignee can contact the agency named in the policy for indemnity.Of course,the procedures may vary by circumstance,but undoubtedly a quicker settlement is necessary if a loss or damage does occur.
The following documents are required for making an insuranceclaim and should be provided by the importer:
♦the commercial invoice issued to the importer,
♦the original bill of lading,
♦the original policy or certificate of insurance,
♦the survey report or other documents detailing the loss or damage incurred,
♦documents supporting claim for extended salvage loss,particular average,or total loss of cargoes,
♦any exchange of correspondence with the carriers and other parties regarding their liability for the loss or damage,and
♦any landing account at final destination.
