Abstract: The personal bankruptcy legislation in China should adopt a unified legislative model, rather than separate legislation.The existing bankruptcy procedures liquidation, settlement and revival can be applied to the personal bankruptcy as formal procedures.On this basis, special bankruptcy procedures based on consumer status or fixed income should be discarded, and a summary bankruptcy procedure suitable for personal bankruptcy cases with simple property relationship should be constructed.The standand of simple property relationship can be further specified by distinguishing consumer debts and operating debts, and supplemented by the principle-exception model to make the application of the summary procedure more suitable for individual cases.(https://www.daowen.com)
