九、结论

以证据了解法律,是美国和欧洲法律的一个重要的新趋势。它的基本思想当然延伸到所有的法律制度,无论它们是否像美国那样以普通法为基础,还是像欧洲大陆那样以立法为基础,或者是混合模式。此时,这种实证主义大多涉及实证研究方法的非理论适用。

本文认为,依赖证据的一个更被忽视的方面,是使用社会科学的理论模式来定义实证主义产生问题的范围。这种方法使社会科学能够扩大法律运作的框架。它在那些被识别为重要的因素(但目前被最小化的因素)方面做出了重要贡献。而且,它提供了一种方法来检验那些基于理论的论点。
